Program Description

This course will detail how the role of expert witnesses must change when the methodology of dispute resolution changes from litigation to mediation, arbitration, and neutral case evaluation. The course will also analyze how the economics of the practice of law and dispute resolution, along with AI, impacts the role of the expert. Finally, the current attack on experts and expertise will be examined along with the response of the "expert community" to that attack.

After completing this course, attendees will be able to:

  • Define the role of experts in dispute resolution
  • Manage and master the evolution and changes in the techniques of dispute resolution
  • Identify the effect of economics and cost on the election of the dispute resolution technique
  • Calculate the cost of risk
  • Recognize how the attack on expertise can affect the expert
  • Analyze and understand how the courts will apply the "Daubert Test"
Take Aways
Attendees should have a thorough understanding of the role of experts in dispute resolution and the factors which determine that role, including the technique of dispute resolution chosen by the parties and the economics which structure those techniques.
