Program Description:
Judge Platt suggests a major change in the paradigm of the judicial branch of government. Meaning, he says, that as we proceed through the 21st century, leaders of the judicial branch of government should be analyzing each and every class of dispute presently in the judicial system; and determining in what forum, by what dispute resolution technique and by virtue of their education, training, and experience, what professionals are best suited to resolve each category of dispute. That means more Certified Valuation Analysts serving as "Court Appointed Experts" and "Special Masters", as well as "Arbitrators" and "Mediators". Judge Gonzalez will then follow up with a discussion of the considerations and pitfalls that exist in the traditional role of Certified Valuation Analysts in the trial courts.
After completing this webinar, attendees will be able to:
- Identify which disputes are more fairly, expeditiously, and economically resolved by professionals from disciplines other than law, as opposed to a full-scale trial before a judge or jury in a courtroom
- Differentiate between the different roles an expert can play in different judicial proceedings
- Identify court-appointed: 1) Expert; 2) Special Master; 3) Arbitrator; 4) Mediator; 5) Neutral Case Evaluator; 6) Neutral Fact-Finder
