This course is designed to assist you in crafting the best engagement agreements to protect yourselves and your firm from liability exposure and other mishaps. Learn from actual experiences of the presenters what works and what does not work.
Takeaways: Identify how to prepare a much better, detailed agreement which will explain what business valuation service you will provide. Differentiate how the agreement will provide specific sections that will be necessary for your protection as well as the client. Recognize how it will provide a basis whereby you will be able to draft an agreement that will be specific to the client and the reason for the business valuation.
After completing this course, you will be able to:
- Determine a uniform structure that may be created as a basis for various types of retainer and engagement agreements
- Identify the reasons for each section of the agreement and how it pertains to the responsibilities of both the valuator and the client
- Recognize that the agreement becomes a "road-map" of protection in the valuation process for the business appraiser
- Determine how many sections of the agreement may be worded differently depending on the specific reason for the engagement
- Identify how, if a particular issue is not stated in the agreement, it may lead to a misunderstanding and possibly a reason for a suit by the client
- Recognize how the use of AI may affect its reliance in your report by a trier of fact in a court setting
- Identify how to address your fee arrangements properly and in a fashion whereby to avoid any future fee disputes
- Determine why you should include an expiration clause in your engagement agreement
