Program Description:
The presenter had the opportunity of being the economic expert for the plaintiff in the initial case in the new Business Court of Texas Eighth Division. This assignment provided an opportunity to argue the modern new business rule as the basis for the lost profits. This case provided the first Daubert (Robinson in TX) challenge in business court and the first judge's ruling on a motion to exclude the expert's testimony. The course reviews the modern new business rule, the case, the judge's ruling, and the outcome of the case.
Takeaways Attendees will have a general understanding of the modern new business rule. They will learn how the modern new business rule can be applied to a complicated commercial damages case. They will learn how the opinions from prior court decisions have provided a road map for applying the modern new business rule. And learn the judge's reasoning for allowing the economic expert to testify after a vigorous challenge by the opposing counsel.
After completing this course, you will be able to:
- Determine appropriate data for a business that never opened for business
- Identify the modern new business rule
- Determine lost profits for a business that never operated
- Differentiate how a written report explains the analysis and loss calculations within the standards for the modern new business rule
- Determine how the modern day business rule can be applied to a certain set of facts through sworn testimony
- Recognize how to defend your methodology and results from criticism
