Program Description:
This session will explore how efforts to protect assets from creditor claims can sometimes be disguised as legitimate estate planning. It will examine the Voidable Transactions Act statutes enacted by the federal government and nearly every state, which protects creditors from being deprived access to assets to satisfy claims. Although these issues often arise in bankruptcy cases, they can also occur in divorces and commercial damage claims. The session will feature real-world examples from litigated disputes to illustrate these concepts.
After completing this course, you will be able to:
- Identify the Badges of Fraud contained in federal and various state Voidable Transactions Act statutes
- Recognize and understand the distinction between legitimate estate planning and estate planning strategies that are used fraudulently to transfer assets into trusts in order to shield them from known or potential creditors
