Program Description:
Providing analysis in a litigation setting can be a complex process for professionals as well as their clients. Numerous court cases have furnished guidance on valuation and financial issues. This practical review of court cases and valuation issues deals with various types of clients and situations, providing guidance in resolving valuation issues and navigating the courts to avoid minefields.
Attendees will be exposed to various types of cases in different jurisdictions and understand the implications in their practice. Participants will be able to discuss their viewpoint and analyze how it compares with other participants. Attendees will develop their critical thinking skills regarding the relevant facts, issues, and nuances of not only existing case law, but any cases in which the attendee may become involved.
After completing this course, you will be able to:
- Identify the pertinent court cases and their impact on clients and expert witnesses
- Differentiate between an objective expert witness and an advocate
- Recognize pitfalls in litigation cases
- Identify differences between what appraisers may feel is "right" and what a court may decide
- Recognize the impact that one jurisdiction or court may have on other courts
- Identify elements of shareholder oppression, unjust enrichment, and damages
- Identify elements of Qualified Appraisal and Appraiser requirements
