Program Description:
This course will focus on Fair Market Value and Commercial Reasonableness under the Federal Stark Law, Anti-Kickback Statute, and False Claims Act. These statutes will be generally described so that evaluator's will have a working understanding of their impact on the health care industry. The presentation will then focus on how the Government (OIG, CMS, DOJ) views Fair Market Value, including the 2021 Final Rules. This presentation will also focus on the Defensibility of FMV analysis, including the view of FMV by the qui tam bar.
After completing this course, you will be able to:
- Recognize how the Government enforces the Stark Law, Anti-Kickback Statute, and False Claims Act
- Identify the penalties that can be imposed if financial arrangements exceed FMV
- Determine how buyer neutrality and physicians/service area factors are applied to the FMV analysis through the recent refinement of FMV by the Stark Law Final Rules
