Presenter: P. Dermot O'Neill
Program Description:
What is your reasonable degree of certainty based on?
P. Dermot O'Neill's explores the concept of reasonableness, why it is important, and how it applies to business valuations. "A sound valuation will be based upon all the relevant facts, but the elements of common sense, informed judgment and reasonableness must enter into the process of weighting those facts and determining their aggregate significance." Although the definition of "reasonable degree of certainty" is implied under both Daubert and Frye standards of admissibility, there is no guidance as to how the terminology should be used when stating an opinion.
In business valuations, "Numbers are not the story, but tell the story." To this end, O'Neill defines what reasonable is, the subjectivity in valuations regarding reasonableness, the Reasonableness Requirements of 59-60, how reasonableness differs between judges and State rules, the importance of context, and the NACVA Review Standards.
After completing this course, attendees will be able to:
- Recognize what reasonable is within the business valuation context
- Differentiate the contextual variables that can affect reasonableness
- Recognize the definition of reasonable
- Recognize the NACVA Review Standards regarding reasonable
- Recognize the key concepts to assess reasonableness
- Select an approach or method to perform a reasonableness check
