Program Description:
After submitting Expert Reports, many practitioners begin incurring costs and expending time writing Rebuttal Reports. Rebuttal Reports take substantial time with calculations, writing, etc. A Review Report involves writing and no calculations and, if well done, frequently result in settlement at a lower cost than a rebuttal.
If settlement does not result, the practitioner can produce a Rebuttal Report by adding calculations. A review/rebuttal is slightly more expensive, but the cost saved on other cases is significant. In my experience, once an attorney sees the results, they will request the review/rebuttal approach in each case.
The hidden benefit—the review process assists the practitioner in writing better Damage Reports because the writing process requires concentration on credibility rather than numbers.
After completing this course, you will be able to:
- Identify a Litigation Review Report as an aid to settlement and, if settlement is not successful, it becomes an outline for rebuttal
- Determine review versus rebuttal in damage litigation
- Determine your opinion on credibility and credibility “alternatives” for your Review Report
- Identify illustrative opposing Expert Reports
- Determine a review of those reports
