  • Avoiding Bias and Remaining Objective as an Expert Witness

Avoiding Bias and Remaining Objective as an Expert Witness

Program Description
Expert witnesses are required by federal and state rules of evidence, the NAVCA Professional Standards and Ethics, the AICPA Code of Professional Conduct, and by SSVS and SSFS to remain objective and unbiased in providing expert testimony. Courts of law have great difficulty when expert witness opinions and testimony appear to be biased toward the party whose legal counsel has retained the expert witness. All of us have our own biases. The key is to identify them and implement strategies to mitigate them in forming expert opinions.

How You Will Benefit
After completing this course, attendees will be able to:

  • Identify how significantly bias can affect the testimony of expert witnesses
  • Recognize how to identify bias in yourself
  • Determine the various ways in which bias presents itself
  • Identify mitigation strategies that can be implemented to eliminate bias
  • Define the rules that can result in expert witness exclusion when bias is not eliminated
Take Aways
You will learn how to recognize bias in yourself, how to eliminate its effects as best you can, and provide unbiased, objective testimony in courts of law consistent with the rules affecting the testimony of expert witnesses.

Who Should Attend
Anyone serving as an expert witness or thinking of serving as an expert witness in litigation settings.
