Advanced Matrimonial Litigation Support Workshop

Program Content
Day 1: Goodwill, Double Dipping, and Professional Practice

Certain issues make valuation of professional practices unique, especially in a divorce context. Differences between personal and enterprise goodwill will be explored in this workshop, and ways to value a business without personal goodwill will be analyzed. The impact of a non-compete agreement on value will also be discussed. The possible “double dip” between income considered in a valuation and spousal support will also be addressed in depth.

After this session, participants will be able to:

  • Explain differences between personal and enterprise goodwill
  • Use various methodologies to quantify personal goodwill
  • Identify characteristics that make valuation of professional practices
    unique
  • Describe different perspectives on the “double dip” issue as it relates to
    various types of assets and other divorce-related considerations


Day 2 AM: Income Determination
Day 2—Forensic Accounting in Matrimonial Cases
This workshop will cover unique aspects of determining family income. Areas will include pass-through entities (e.g., partnerships and S corporations), income and non-income producing assets, family lifestyle, unreported income, imputation of income, cash, and other sources. Participants will also learn how such items impact support.

After this session, participants will be able to:

  • Identify sources of income and components of cash flow
  • Employ strategies and techniques in the calculation of income available for support
  • Articulate these concepts in a court setting


Day 2 PM: Settlement Strategies and Techniques
Financial experts can play a key role in settling complex divorces cases. This workshop will explore various options available by incorporating tax strategies, valuation theories, income analyses, and the underlying nature of the marital estate.

After this session, participants will be able to:

  • Assist legal counsel in identifying key financial settlement concepts
  • Employ strategies and techniques learned
  • Calculate and illustrate settlement alternatives


Day 3: Document Management Process
The document management process of an organization is critical. Document retention policies, evidence spoliation, and electronic evidence will be some of the topics discussed in the demonstration of one firm’s unique document management process. The Denver session will have a community property orientation. The focus will be on tools and techniques to improve separate property tracings and how to deal with tax issues. The entire process will include a hands-on case study with spreadsheets and templates. The Washington, DC session will address methods and issues faced in the valuation of employee stock options.

After this session, participants will be able to:

  • Properly employ the templates designed to help with community property
    issues
  • List the issues that impact the valuation of employee stock options
  • Understand the steps necessary in managing documents and evidence needed in a case
Who Should Attend
This program is ideally suited for practitioners with more than three years of matrimonial litigation experience. This is a great course for senior level accountants and financial forensic experts.
